Texas Compliance Corner: SB 2024 Enforcement Update
We've gotten a lot of questions this month about what's actually being enforced versus what's just internet noise, so let's clear it up.
SB 2024 itself hasn't changed since it took effect on September 1, 2025 — it's still a Class A misdemeanor (up to 1 year in jail, up to $4,000 in fines) to sell or market Chinese-manufactured disposables or any cannabinoid vape (THC, Delta-8, CBD) in Texas. That part is settled law and enforcement has been steady. Possession by adults 21+ remains legal — this law targets retailers and sellers, not consumers holding a device.
What's new is on the hemp side. Texas DSHS finalized updated rules on March 6, 2026 that changed how THC is calculated in hemp products — shifting from a delta-9-only measurement to one that includes THCA. In plain English: that closes the loophole that let "technically compliant" THCA vapes and smokable flower skate by. If it converts to THC when heated, it now counts, and that effectively removes hemp vape and flower products from legal retail sale in Texas.
Here's the part that matters most for our customers: none of this touches nicotine vaping. Every product Big D Vapor carries — Fifty Bar, NORTH, DOJO, EBCREATE, American Standard, Geek Bar — is nicotine-based, US-compliant, and was never part of the cannabinoid or hemp categories targeted by either rule. You can keep shopping with us exactly the way you always have.
Bottom line: nicotine vaping is alive and well in Texas. Cannabinoid vapes and hemp flower are not. Know the difference, and you'll never run into a problem.
